Informative on the Treatment of the Personal Data of the Roma Capitale Wi-Fi Service, according to the EU Regulation 2016/676 on General Data Protection (GDPR)

Pursuant to the EU Regulation GDPR 2016/679 "General Regulation on Data Protection", implemented by the Italian Legislator through the applicable Dlgs n.101 10/08/2018 and subsequent updates, the following information are figured out.

  1. Purposes of the processing

    The personal data provided with this document - as well as those already held by the Administration - will be processed exclusively for Institutional communication purposes, data mining and statistics archive. The Archiving and historicization of the DigitromaWiFi User Data, made anonymous, is published on the Roma Capitale Open Data website (https://dati.comune.roma.it/od/en/progetto.page), in compliance with the provisions of art.6 par. 4. The previously registered user can withdraw from the service, at any time, by resorting to the "cancellation of personal user" function from the appropriate menu on the main access web page, in accordance with art.17.

  2. Methods applied to the processing

    In compliance with the principles of lawfulness, data minimization and conservation limitation, pursuant to art. 5 of Regulation (EU) 2016/679, personal data will be stored for the period of time necessary to achieve the purposes for which they are collected and processed, for seventy-two (72) months since the date of collection from the interested party, with reference to art. 13.

    The processing of data for the aforementioned purpose, announced into paragraph 1:

    • is realized through operations or complexes of operations indicated by article 4, according to the methods mentioned into article 5 of the GDPR 2016/679;
    • is carried out with the aid of electronic means and / or methods, aimed at ensuring the needed level of data protection and suitable for guaranteeing security and confidentiality, in compliance with the provisions of articles n.32 par.1 and succ. following GDPR 2016/679.

    The data will be saved for a suitable period, according to the adherence to the DigitRoma Wi-fi Services by the user and in compliance with the current Legislation.

  3. Data Presentation and Giving

    The presentation and giving the required personal data is mandatory.

    Any refusal to provide personal data by the interested party implies the impossibility 'for the same, to use the service for which a registration is expected.

  4. Data Communication and Spreading

    In the case that the chosen service is managed in whole or in part by another person, your data will be communicated, as requested and / or expected, to individual managers, who will operate as Data Controllers for the treatment connected to the provision of services of own competence. The personal data are not allowed to be spread or communicated to a third party, with the regulatory exception prescribed by the Laws.

  5. Data Controller Officer

    The Data Controller Officer of Roma Capitale is the Mayor of Roma Capitale with registered office in Palazzo Senatorio - Piazza del Campidoglio 1 - 00186 Rome, PEC: protocollo.gabinettosindaco@pec.comune.roma.it.

  6. Data Processor Officer

    The legal indication, listed into art.28 of the GDPR 2016/679, is applied with particular reference to subsection 1.2 .

  7. Data Protection Officer (DPO)

    The Data Protection Officer of Roma Capitale is available to the following addresses : email rpd@comune.roma.it - PEC protocollo.rpd@pec.comune.roma.it .

  8. Rights of the interested party

    At any time, the identification data and the methods provided may be requested from the data processing manager.

    In relation to the processing of the data collected, the interested party may exercise the rights provided by the art. 11 to 22 and 34 of the aforementioned EU Regulation GDPR 2016/679. In particular, the interested party can obtain from the data controller or data processing managers, without delay:

    1. confirmation that the processing of personal data is in progress or not, and, in this case, to obtain access to it and make it available in an intelligible form;
    2. obtain information about the purposes of the processing, the categories of personal data, the recipients or categories of recipients to whom the personal data have been or will be communicated, when possible, the period of storage;
    3. obtain the correction and deletion of data;
    4. obtain the treatment limitation;
    5. obtain the portability of the data, ie receive it from a data controller, in a structured format, commonly used and readable by an automatic device, and transmit it to another holder of the processing without hindrance;
    6. oppose the processing at any time;
    7. oppose an automated decision-making process relating to natural persons, including profiling;
    8. ask the data controller to access personal data and to correct or cancel them or limit the processing that concerns them or to oppose their processing, in addition to the right to data portability;
    9. revoke the consent at any time without jeopardizing the lawfulness of the processing based on the consent given before the revocation;
    10. to lodge a complaint with a Supervisory Authority.

    It is specified that the user's requests regarding the exercise of his previously listed rights can be communicated through the Institutional contact point, through the toll-free number 060606.

  9. Mode of exercise of rights.

    If the prerequisites are fulfilled, the interested party may propose a complaint to the Authority for the Protection of Personal Data, as provided for by art.77 of the aforementioned Regulation and by art. 140-bis 143 of the Italian Code, regarding the protection of personal data. The complaint can be delivered by hand to the offices of the Authority for the Protection of Personal Data, at the address indicated below, or by forwarding:

    1. a registered letter with return receipt, addressed to the Authority for the Personal Data Protection, Piazza Venezia, 11 CAP 00187 - Rome;
    2. certified electronic port message, addressed to protocollo@pec.gdpr.it
